ug, ebay deal gone bad, looking for advice - mattkime - 10-12-2010 i bought an item off ebay and it didn't arrive as described (like new.....its dead). so i filed a complaint with ebay. they say they'll make up their mind in 48-72 hours. that was about a week ago. in the mean time the seller sent me a message saying "please send back my item". i'm inclined to wait for ebay to rule but i'm not certain they have any intention of doing so. now i'm sitting and waiting to chat with service at ebay. 20 minutes ago they said it would be a four minute wait. ug, what to do? If he does not refund your money, you can then file with eBay and PayPal and have that as proof that you did your part. eBay and PayPal almost always side with the buyer on these type of disputes, so I don't think you have anything to worry about. If you claim that you had an agreement via regular email/phone, they'll just day that this is no way to verify it. It is best to call ebay to nudge things along. Really, better to open the dispute on the paypal side since their CS is vastly better. but it's too late for that. If the seller agrees to accept the return (via ebay message system) then you should be just fine. Could be that the seller is under pressure with his paypal account hogtied for the amount of the purchase. Sounds like you'll eventually be ok... Accept seller's solution, or escalate to eBay. eBay should only take 48 hours to make a decision if you escalate. Did you simply start the claim procedure or have you already escalated? Even if eBay sides with you (and they probably will), they are going to tell you to send the item back to the seller (the only variable is whether or not eBay foots the bill for shipping). I've only been asked (by eBay) to ship one item back to the seller and in that case eBay sent me a shipping label because it was a giant LCD TV. My complaint was that it was missing the remote, but because the seller wouldn't agree to a partial refund (seller went out of business and was MIA), eBay wanted me to ship the whole thing back. So I sent the power cord back (b/c I was fairly certain the seller was out of business), and the package got returned to me. I told eBay I shipped the "TV" but it had been returned to me by UPS. eBay confirmed the item had been delivered and refunded my money (purchase price + shipping) and I got a free TV (well, it cost me $15 to buy the remote on eBay). If the seller refuses delivery OR if the address that he provided ebay is wrong, YOU win. and Ebay seems to be paying for return shipping for everything and on an aside, I expect this is really killing their bottom line.
