The finding is a bit of legal kung-fu... In summary, Montana tied their no voucher law to religion, Oops. If they had said 'no private schools' it would probably have been okay. @#$%&. Can't have it both ways, MT... you have to ignore the word "religion" utterly in all laws.

"Here, the application of Montana’s no-aid provision excludes religious schools from public benefits solely because of religious status. As a result, strict scrutiny applies."

Roberts did the right thing. If you're gonna use state funds to prop up private business, let anyone in. Let it become just as diluted as they like until no one is properly funded and held accountable.

Montanta's core mistake of course was in allowing taxpayer funds to prop up private business, no matter how many may have said they like the idea. It's now up to them to decide which they prefer, the whole range of sabotage or just the one entity the system is designed to provide.
