Trump suggests delaying election amid fraud claims, but has no power to do so

President Donald Trump suggests the United States may need to “delay the election” on November 3.

Trump has no power to unilaterally delay elections, and there has never in American history been a successful effort to delay a presidential election.

Several states have expanded access to mail-in ballots to help people vote safely during the coronavirus pandemic, but Republicans, led by Trump, have vigorously opposed expanding access.


.....President Donald Trump on Thursday suggested that perhaps the United States would need to “delay the election” on November 3, claiming that mail-in voting would make this fall’s election “the most inaccurate and fraudulent in history.”

Trump has no power to unilaterally delay elections, which were set for the day after the first Monday in November through a mid-19th century law passed by Congress. Since then, it has never changed, said presidential historian Michael Beschloss.

But Trump is trailing in the polls by double digits to Democrat Joe Biden, and election experts have long worried that the president would actively try to interfere with the election in order to prevent a potential loss.

As states grapple with how to help citizens vote safely during the coronavirus pandemic, many have turned to mail-in voting as a potential solution that allows people to cast their ballots without waiting in long lines at potentially crowded polling places.

But Republicans, led by Trump, have strongly objected to expanding access to mail-in ballots, claiming without evidence that voting by mail invites voter fraud. Trump’s presidential campaign and the Republican National Committee are spending tens of millions of dollars this year on lawsuits to challenge state efforts to expand access to mail-in ballots.

Trump and several of his top aides all vote by mail, so the president has recently claimed that absentee mail-in ballots are totally different from other types of mail-in ballots, such as the ones that states could let voters apply for if they feared contracting coronavirus at a polling place. But experts say there is no functional difference between the two.

Thursday is believed to be the first time Trump has publicly suggested delaying the November election, raising questions about the timing of his incendiary tweet. Moments before Trump tweeted, the Bureau of Labor Statistics announced that during the second quarter of this year, U.S. Gross Domestic Product had fallen by a record level of 32.9% annualized.

The stunning figure, which is exponentially larger than any previous quarterly economic loss, was made worse by the news that weekly unemployment claims also rose last week, indicating that the recovery Trump has long promised is not happening. Instead, a new wave of coronavirus outbreaks have exploded in states that reopened early this spring, and commerce in parts of these states has ground to a halt, driven as much by individual fear of infection as by statewide closure mandates.

As sure as the sun rising in the morning. At this point, I can only believe that if Trump loses, he will not only question the results, he will, at the very least, dog whistle the hell out his supporters to immediately reject the results out of hand, no investigations needed.

As an aside, most GOP operatives think that forcing in-person voting is the end of the GOP. Mail-in voting has largely HELPED the GOP over the years, as it helped committed voters which tended to be whites.

Speaker Nancy Pelosi (D-Calif.) responded to President Trump’s tweet floating the idea of moving the election by tweeting a quote from the Constitution that cites the Congressional authority needed to do so.

“Article II, Section 1 of the Constitution states: ‘The Congress may determine the Time of choosing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States,’” Pelosi tweeted Thursday.

Pelosi’s tweet was in response to Trump’s from earlier in the day, floating the idea of moving Election Day — which as president he lacks the power to do unilaterally.

After the president’s tweet, “President Pelosi” trended on Twitter, with users noting that even if an election is delayed, Trump’s term in office would be up in January making Pelosi the next in line.

Trump’s Thursday morning tweet marked the first time the president has raised the idea of delaying the November elections, an idea he previously rejected amid concerns about the coronavirus pandemic.

Election Day takes place on the Tuesday after the first Monday in November, as determined by federal law. Moving the date would require an act of Congress.

He cannot postpone the election and he knows it. He also knows how to dominate the news cycle when other news is especially bad for him (the economy) or flattering to somebody he doesn't like (the late John Lewis).

No one has the power to push it past January. The Constitution is bigger than all of us.

I do not believe even an Executive Order over rides the Constitution.

And each and every elected official swore to uphold the Constitution against all enemies, foreign and domestic. Even the attempt to over ride the Constitution, especially by someone idiotic enough to do it in writing, should be brought up on Treason charges, because they just abandoned their oath.

Lots of politicians should be in federal jails already for breaking that same oath over the decades.
