Justice Dept takes over Trump’s personal defamation lawsuit

“The Justice Department on Tuesday intervened in the defamation lawsuit brought by a woman who says President Trump raped her years ago, moving the matter to federal court and signaling it wants to make the U.S. government — rather than Trump himself — the defendant in the case.

“In filings in federal court in Manhattan, the Justice Department asserted that Trump was “acting within the scope of his office as President of the United States” when he denied during interviews in 2019 that he had raped journalist E. Jean Carroll more than two decades ago in a New York City department store. Carroll sued Trump over that denial in November.”

It’s not a problem to be indefensible when the full weight of the law appears on your side.

Hold up your hand if you, as a taxpayer, are willing to pay for it. Well, all this is a tempest because making the US A the defendant...you can’t sue the US government so moot moot moot...a legal slight of hand.......

I want this to go to the Supreme Court. I'm tired of this "President is Above the Law" bull, and want a down home constitutional smackdown to take place. Even a 5-4 judgement will suffice.

Wasn’t there a civil case, oh, maybe 25 years ago, where some woman claimed a high governmental official exposed himself to her? And the official maintained he couldn’t be sued because he was the president err a high governmental official? And the Supreme Court said Heh heh - can’t get off that easy - the case must go forward.

And that guy had to pay for his own defense, even though he was...a high governmental official at the time.

IIRC, even though the case itself was groundless and eventually thrown out of court, it caused quite a bit of turmoil and distraction in the country, while at the same time there were 20 guys learning to fly planes into buildings.

Funny how things change when one letter changes from D to R.

Barr knows perfectly well that the courts are going to reject his arguments for this. It's totally spurious. There is no legitimate public purpose in pursuing this - it's Barr letting Trump use the power of the government to benefit himself - again! In this case, he is letting Trump use the government to delay having to give a deposition that is likely to be quite uncomfortable for Trump - especially if he has to do so before the election.

In a bizarre case of history repeating itself, Ms. Carroll saved the dress she was wearing when it happened.
