They can try. It may work as long as the stalker victim lives outside Apple's walled garden. I can imagine how an AirTag might be physically disabled. Similar to Bambi vs King Kong.

in regards to tracking people surreptitiously, if you have a tag on you that is not paired to your phone the tag sends a notification to your iphone that basically says “hey, are you aware someone is following you?”
