Similar, but not copied, image found to breach copyright

Having read the whole decision I can understand the Judge's reasoning but strongly disagree with it as this would be the thin end of the wedge towards allowing the copyrighting of a mere idea. I wouldn't be at all surprised if it wasn't overturned on appeal.

Seems like a step in a potentially very bad direction. I understand how the judge got there, but this is scary.
