Except if it's used as bumper music, according to Limbaugh..it's fair use.

He also said that some bands had complained about his use of their music but since the "bumper music" clips he uses are less than 8 seconds the use of the music is legally considered "fair use"

i'm not well informed about fair use of music clips, so I don't know if this is legally accurate.
