I don't think it matters if you can redistribute it or not. But I guess that would be the first step; defining what is "Freeware"

After checking the license, it appears so to me. They charge nothing, they ask for nothing except for giving credit where credit is due.

That's what I'm thinking. He says that a free software license is not freeware. And he is right. a free software license just allows you to copy or redistribute software that would normally be commercially trademarked or something like that. But in this instance it has a free software license but the software itself is also free. So I say it's freeware!

It is "freeware" in that it's free software. But that's giving the word a pretty loose definition.

Freeware usually refers to closed-source software with licensing terms restricting uses, modifications, decompiling, etc.

If you're going to talk about Apache Tomcat's licensing then you should call it FOSS (free and open source software).

This is a key section of the license for the Adobe Flash plugin (freeware):
You may not alter, merge, modify, adapt or translate the Software, or decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-perceivable form.

This is a key section of the Apache license (FOSS):
2. Grant of Copyright License. Subject to the terms and conditions of this License, each Contributor hereby grants to You a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright license to reproduce, prepare Derivative Works of, publicly display, publicly perform, sublicense, and distribute the Work and such Derivative Works in Source or Object form.
