I was defrauded on a cellphone on eBay. SNAD. Sold as new and it was not working old junk. I was awarded $71 of the $96 that was stolen from me. Plus I am out the $9 shipping to return the item. Half-assed guarantee. I give PayPal a Negative. The seller should be banned. Why not? Or killed? I know where he lives.

That's why I have PP draw from my Amex card - 100% satisfaction guarantee. If they did that with me, then I'd go get a refund from Amex. Also, Amex can't give a partial refund, so I'd end up ahead (not by intention though.)

account. This is the maximum amount covered by eBay's Standard Purchase
Protection Program.

Why doesn't the seller pay the full amount? He gets a free pass as a crook.

PP really does sucks but as a buyer pay through PP with a credit card because you can at least dispute the charge with the credit card company.


Happened to me once and I was able to dispute the charge and got 100% of the money back.


BUt congrats that you got anything back from them at all. . .

You chose to buy from a seller who was not backed by the PayPal Buyer Protection Policy. When this happens, any coverage you might get is through eBay's Standard Purchase Protection program. That has a $25 fee (taken from the money awarded you) and a max claim allowance of $200, meaning the most you can recover is $175.

If you want your $25 back, and you paid with a CC, you can do a chargeback.

If you do do a chargeback and your CC company gives you more than $25, then you need to get the overage back to PayPal. if you did not, they could (and have) put a hold on your account until they are made whole. IOW, you can't get back more than you originally paid.

Last year, we did a chargeback through AMEX for furniture that we bought off eBay. We payed through PayPal (charged to the AMEX). They buyer repeatedly told us he would make restitution, replace the furniture, etc. until the 90 days were up. Then we stopped hearing from him. PayPal refused to do anything about it b/c it was past 90 days of the auction ending.

So, we did a chargeback with AMEX and they credited my account the full $1400. Once that went through, however, PayPal suspended my wife's account saying that doing a credit card chargeback violates their policies. They have since sent her numerous emails asking her to check her account and reactivate it. She has just been using my account, which is fine.

I recently bought a lamp that was very poorly packed and arrived broken. The seller again said she would refund the money but only via money order. She then stopped responding to my emails. I filed a claim with PayPal who determined she was at fault and ruled in my favor. However, since her PayPal account was empty, they could not refund any of my money (it was only about $22). Her eBay account went away so I couldn't even leave her negative feedback. PayPal said that if she ever gets money back in her PayPal account, they'll deduct what is owed to me automatically. I don't believe them.

This time, they did not complain or suspend my account when I filed it with AMEX. However, the amount was much less than last year.

Per PayPal's UA, as long as you give PayPal the chance to resolve the problem first, you are absolutely allowed to do a CC chargeback. If you bypass PayPal, however, per the UA your PayPal account may be suspended.

In my case, we tried PayPal after trying in good faith to resolve the issue with the seller. However, they only give you 90 days from the end of the auction, which seems like a lot, but the problems with the furniture did not develop until about 6 weeks after we recevied it. Then he made promises, stalled, made excuses, went out of town, stalled some more, etc. By the time I finally contacted PayPal and eBay, 90 days had passed so I had no choice but to go to AMEX.

If the guy is that much of a slimebag no way is he going to make restitution. He knew he was screwing you going in. Don't you know any legbreakers to make a bad impression on him or bad teenagers to vandalize his car?

I know that route. I'm actually surprised Amex helped, usually they don't go past 90 days too. I once had a retail store sell something that was essentially DoA and then drag out the process to get it replaced. I followed the calendar closely and started my dispute on day 87.
