Urgent - cousin called from Houston courthouse with DUI, needs $1000, lawyer is supposed to call me. It sounds 90% like him. Is his a scam?

I tried to ask him a personal question to verify him but it didn't work. I don't have his number anymore and I'm supposed to keep this secret.

99.99% probability this is a scam. BUT.. if you're worried and you know the guy well and think this is likely....

call his HOUSE and see if he's there. Do some due diligence. Is he likely to call you for stuff like this ? Then call the jail and see if he's in jail.

when 'the lawyer' calls, get a name, office address, office phone, call back number. And then check it out too.

Odds are if you start asking difficult questions they will pressure you to immediately send $$ and not answer them.- or- hang up. If they answer clearly and easily the probability of it being legit just went up to 0.02 %.

He said he doesn't have his number anymore.

It could be a scam, but if he's close to you and you want to help him out, as suggested above, you probably need more info to show he is actually in jail.

If he has an attorney that's about to call you, it should be fairly easy to expose a scam. Be cautious.

Most likely a SCAM. If he was arrested for a DUI then he needs the 'come to Jesus' moment. Let him stew in his juices for a bit.

You should send him an extra $1,000 so he can move far away. Someplace like Dodge City, Kansas.
So he can call again asking for money to get out of dodge.

The problem is that it sounded 90% like him. I haven't talked to him is 4 years. Everything else sounds scammy when you look at it from that angle. The "public defender" is supposed to call me back "after court" for some other case.

I just remembered that my cousin's closest friend back here in Arkansas (he's in California) is our lawyer cousin. If they call back I'll ask for their number so our lawyer cousin can call them. Also I played back his accent in my head and I can hear the difference. This will be funny to bring up the next time I see him.

FIRST OF ALL. Nothing is URGENT here. If he got caught, and he got bonded, then it's a matter of gathering your facts. If he spends a night in jail so what. It's just Tuesday. You can call the jail or you can call a Houston Bail Bonds company and find out what's what. The Bail Bonds people want your money so they should have an incentive to check it out.

You haven't talked to your cousin in FOUR years and you're the guy he uses his dime on to ask for bail??? IF it really is your cousin, it sounds like he's burned through 4 years of closer acquaintances to get to you. Either way this sounds like a bad risk. I vote SCAM!

If I had a cousin that was arrested for DUI, they would know I would slam the phone on them. OK, I wouldn't slam by iPhone but the expression still has a nice old fashioned visual statement to it.

If he needs the money he will call again. This is his problem, not yours. As to keeping it a secret, forget about it...these are the kinds of things that shouldn't be kept under wraps.

I have a friend that was scammed this way. It was his grandson in jail in Mexico. Told him not to tell his mother. My friend sent the $1000 thru Western Union.

My friend told me about this later in the day and I said "scam". He called his daughter and found that the grandson had not left CO in 2 years.

When the "attorney" calls, get his/her name, law firm name, email address and phone number.

Google it all and check [www.martindale.com] for the attorney's name and firm.

Every practicing attorney in this country will have their name on a registry. It's unlikely that they would not appear in Martindale Hubbell's directory, but they certainly would appear in bar rolls and such in Google results.

If they're masquerading under a real attorney's name, they nevertheless won't have a working email address from the domain of a real law firm or a phone number that you can trace to a real law firm with a Google search.

This is how I exposed the scammer collection agents who were trying to use me to find my brother to collect on an expired debt. They had a script with outright lies and jargon designed to make it look like they were attorneys, but had nothing to back it up. (And I reported them to the FTC.)

Sorry. The attorney did call back after about 10 minutes right on schedule. I asked enough questions and made enough accusations that he won't waste his time calling back a second time.

Well, at least you didn't fall for it. However, why did it take all your friends here on MR to convince you it was a scam? Don't be an easy mark next time, or at least don't answer the phone until AFTER you take your shot LOL.
The fact that you haven't spoken to him for four years should have tipped you off. If somebody, friend or relative, calls me up after four years of no contact, there's no way I'm going to send them money.

The fact that you haven't spoken to him for four years should have tipped you off. If somebody, friend or relative, calls me up after four years of no contact, there's no way I'm going to send them money.

Events like this can be so startling that it helps to get your friends to confirm what you already know. After all, who wants to make the wrong choice? The easy marks are the ones who DON'T stop to think.

A common scam. Just might be him, though, looking for drug money.

If you talk to him again, ask him a few questions about family members or pets that would be known only to an insider.

Draw him into recalling the time the two of you took your dog Dillon (who never existed) to the beach (which never happened).

If he remembers this, the call is a fantasy.

There are lots of people talking about what they would do if this happened to them. I know it's reassuring to think that in a moment of high-pressure, frightening/threatening discussion we would all stay completely cool, but it's not that simple. Sure, some folks are either 1) constitutionally very calm and hard to excite or 2) trained to respond to high-pressure environments by staying cool, but most of us respond poorly to this kind of stimulus. It can be extremely disorienting and scary to have someone call and tell you that if you don't do something, they will go to jail, or the sheriff will be coming to arrest you. It can throw off your capacity to reason, to be critical, to express skepticism. That's why these scammers do this: when people are cognitively impaired by their own hormones and neuro-responses, sometimes they do foolish things (like wire $1,000 to Mexico).
