FU: interesting message from Amazon Marketplace customer

previous thread - [forums.macresource.com]

Amazon states that you must be an "authorized seller" of an item listed in the amazon marketplace....which is pretty ridiculous considering that every item on the site has a little button that says "have one to sell?"

obviously this is only enforced when sellers complain yet their complaints do not need to be substantiated.

for entertainment value i responded to the person who contacted me explaining that i bought the item from them, have only one, and wish to have permission to sell it on amazon. i don't expect a response.

Was it listed as new? Clearly that's not really true because people sell new game consoles, TVs, and the like, and don't seem to be an authorized seller. Try listing is as used, like new.

Yeah, it's like I said in the previous thread:

The truth of the matter is if Amazon barred...the listing of items as "New" by sellers who aren't "Authorized Dealers", then they would lose a SIGNIFICANT...revenue source stemming from their third party marketplace sellers, of which the bulk (I'd think) are small time sellers/private individuals like mattkime. They do NOT want to see this happen. They have the best/successful (by far) third party marketplace. If this is indeed a rule, then they are willingly turning a blind eye to the situation, only addressing it on an individual basis, so they don't turn their whole boat over.

I understand that you like to know if permission is needed for an item to be listed as "like new". We appreciate your interest in knowing the policies of selling on Amazon.com.

I would like to inform you that you will have to get authorization from the trademark or copyright owner if the item is trademark item regardless if the item is sold as new, used or like new. the reason is because Amazon respects a manufacturer's right to institute policies and rules to manage and control the distribution of its products. However, Amazon considers the enforcement of these policies and rules to be a matter between the manufacturer and the retailers. As a result, it would not be appropriate for Amazon to assist in such enforcement activities.

Please note that we do not consider the use of a product’s name to sell that product to in any way constitute copyright or trademark infringement.

Hence In this case, I suggest you to delete the listing or get the permission from the manufacturer in order to list the item, so that you doesn't violate the Amazon selling policies and you may not suffer from removal of your selling privileges.

If you have questions about our policies, please search on “Selling Policies” in our seller Help pages.

We want you to be successful in selling on Amazon,

Please let us know how we did.

Were you satisfied with the support provided?

WTH?

They're first telling you that they consider the right to sell an item a matter between the seller and the manufacturer, and so they won't participate in any enforcement action.

But then they say you have to have permission from the manufacturer to sell the item or Amazon will revoke your selling privileges!

Did I just read all that correctly?

On checking, I see that this product listing doesn't have "like new" condition so you are unable to list your product in "like new" condition.

So, in this case, I request you to list your product in the "Used" condition which doesn't require permission from manufacture to list your item.

"Like new" is used, does Amazon even understand their own system?

"Used - like new" >>> what you want to list as to avoid this problem.

"On checking, I see that this product listing doesn't have "like new" condition so you are unable to list your product in "like new" condition. "

I agree, however, Amazon isn't making a lick of sense.

There is a "Used - Like New" condition for the OP's item. He's actually using it for his current listing. When he posted his original thread, he was using the "New" condition.

Based on the text of that communication from the Amazon rep, s/he is not a native English speaker and may not have understood the OP's inquiry. Either way, s/he provided incorrect information about the availability of the item condition for this product, which calls into question the rest of his/her response. This item condition is available for all products in the cell phones and accessories category, and a rep should be aware of this.

Yeah, that's not a very clear answer. I agree the rep seems to not have any idea.
