I was just checking some auctions to get an idea of value for my 450 duallie. Same picture for two different sellers? I know I'd be pissed if I took the picture for my own use and saw it in another auction.

It happens all the time. If reported eBay will usually pull the auction of the photo thief.

I despise the auctions that use eBay's Stock photos, I will not buy anything that has a Stock
photo attached to it, if they're too lazy to snap their own they will get no business from me.

I sold an item last year and then a couple of month later noticed the buyer was re-selling it. He not only used the pictures that I had on my auction, but he also used the same text and layout. I didn't mind that he was re-selling the item, but I was a bit pissed that he just copied and pasted my entire auction for his use. I did not have anything copywrited, but it was just poor form on his part. I emailed him about this (the auction was closed) and he did send me an apology letter, saying he didn't realize that kind of thing was frowned upon.

I usually use the fact that a stock photo (or someone else's photo) was used as a very weak indicator of the "scam" potential of the seller. There are times however, when a stock photo might be allright...such as when it's a rare item that's highly in demand.

Just today, I sold an Epson C84 printer (only used a stock photo) that was new (sealed-in-box) for about $215 shipped (why do these things sell for so much?...I bought if for about $27 more than a year ago!). I couldn't believe it. I even stated on the auction that I was selling it as-is (due to it having been purchased over a year ago and the ink cartridges might be expired). I priced it high, and I knew it. I figured if it didn't sell the first round (took advantage of the 10-cent listing promo), that I could always relist it at a lower price. I even agreed to sell it at a lower price to a potential buyer ($165, shipping paid by buyer in the form of a pre-paid shipping label, still a good price relative to other completed auctions). I told him I'll wait to lower the BIN price once I received his payment. That was last night. Lo and behold, this morning I find out someone else bought it before he sent me the payment. Go figure sometimes.

I have to disagree. Who would buy a rare item if they couldn't see the actual item?
