Any advice about my misbehavin' iPod?

I got a new 80gb 5G almost 3 months ago. From the start, it acted weird - but sporadically and inconsistently. The problems were:

(1) random restarts
(2) when starting iPod after having it off, would play a track but no sound (time would advance, but no sound)
(3) when starting iPod after having off, would not play videos

For #2 and #3, I would have to restart the iPod to get it to work.

I restored the ipod, but the problems persisted. I finally broke down and got an applecare ticket and sent it back for repair.

They sent my same iPod back to me with a note saying it performed fine and met standards. I doubt #1,#2, and #3 above are "apple standards".

At this point, I've just been living with the problem. Obviously, they were not able to recreate it, because, like I said, it is sporadic. It happens mostly after I let the iPod turn off, and I come back to it a few hours later.

There are reports of at least #2 on the Apple discussion boards, and one person suggested downgrading the system software. I haven't tried that yet.

So, what is my next move? Call Apple and try to get a replacement? Go to the Genius bar (ugh)? I've owned 6 iPods - and this is the first time I've had any trouble like this... frustrating.

contact Apple again. maybe a different tech (or set of techs) will look at it this time.

it's a pain, but I'd persist and keep it up until they make it right.

It might be best to go to the genius bar so you can show them the problem.

I have the same issues until I figured out it only happens when I plug my earbuds in before turning it on. If I wait until its on, then plug them in, no issues. A bit of a hassle until you form the habit of waiting.

Interesting! I will try this.

They are sending another box.

They won't replace it until the third time.

Like I said, I tried restoring (several times).

The product specialist from Apple said, "This is obviously a hardware problem", but she insists that they cannot outright replace it until the third time. So, I will go through the hoops.
