URGENT: Who should she report to?

Due to a car accident, my S/O is driving the rental 05 Hyndai Santa Fe 96 while her Toyota RAV4 is in the shop for a body work. She did not buy the insurance for the rental vehicle. Just now she informed me that some #%^& at one of the clinic satellites she works scratched a three feet long X on the door. Should she report to her insurance, State Farm, and/or the rental company, Enterprise? Her deductible is $500 ... OUCH! TiA

she will have to report it to both.

i had an enterprise rental damaged a few years ago. it wasn't my fault; i was sitting in the rental eating lunch and a tree removal truck working in my driveway rolled into it.

enterprise charged me my geico deductible but geico reimbursed me when the truck's insurance company paid for the damages.

unfortunately, my guess is you and your S/O are going to have to eat the deductible on this one since the culprit is probably not going to step forward.

Seems that the rental company must maintain insurance on its cars to cover vandalism. Insurance she purchased would cover errors in judgement she made that caused an accident while she was operating it, but she can't have any control over the actions of others, especially when she's away from the car. You might want to consult an attorney to see where her liability lies before admitting responsibility. Good luck!

Any chance of video monitoring of the lot, or witnesses to catch the miscreant? Was the RAV4 damage her fault? If not the insurance company should have covered the cost of the rental & insurance for it as a normal operating expense. Bummer.

I liked the big Einstein pic better.

The car accident was the other party's fault whose insurer is paying for the body repair of my S/O's 86 Toyota RAV4 AND her rental car as well AND her doctor's visit for a whiplash. Lawyer? That will cost more than the $500 deductible. Darn, what a lousy way to start a new year!

I reduced Einstein's picture because I didn't want to subject the posters on dial-up connection to a stand-still.

yeah, but from personal experience, if the rental agency can get you to pay for the damage, and they get reimbursed from their insurance company, getting double, they will go for it.

I had a windshield crack on a minivan rental with less than 1500 miles on it. They claimed it was a $1500 piece of glass. That piece of glass from the Ford dealership across the street from the rental co. was $600 retail. I guess they were going to pay $900 for the install....... I then told them it was actually a corporate rental, and they looked it up. The price for the windshield went to 1K immediately.

I just turned the matter over to the company corporate lawyer and was never billed, even though it was on a personal card.

How much was the deductible when Rachel Corrie got flattened by that tractor? LOL she must've looked like the Cayote after some huge truck with the word ACME ran over him. ROTFL!!!!!!!!!!!

The thing about this is.......

If you could keep track of it by the car's VIN, you could use CarFax to see if the car is insured and there is an additional payout.

I seriously doubt that Enterprise maintains "insurance" on their vehicles. They will have an umbrella policy of sorts, but this petty damage to the car is exactly why they offer you insurance. It is insurance that is paid to repair the car by THEM.

Being self-insured is nothing new.

When you think of the people who are killed driving an Enterprise rental, and Enterprise and its re-insuring agent are the ones who pay those damages. There is no "State Farm" per se', it comes out of Enterprise's pocket, just as employee benefits do.

I suggest you get her to park on an angle, but still within the yellow lines, next to some tall dump trucks, ANYWHERE, and hope that one of them makes the crease even worse.

That will take care of that problem.

Enterprise made it sufficiently clear to me that if I chose not to use their "service" that they would be billing USAA for damages. I took photos of the car at that point, just to be certain of who was right in assessing any potential damage upon return.

The pressure they used was incredible. But as you are now discovering, the $10/day or whatever it is, even for a week, is well worth it, because you never know when some dorkhead is going to ask you to bend over.


ps.... the situation to which G-Man so callously and remorselessly (enter shed tear rolling down cheek) is so insane it is actually worthy of a joke. Here sits an idiot idealist in the midst of an Israeli battleground, as they bulldoze houses with military dozers.

Now the family is suing Caterpiller USA for "knowing selling heavy equipment used in actions which endanger people" or other such nonsense. Next someone will be suing rail companies for having relatives who sit on train tracks scraped from the rails.

“International law clearly provides that corporations can be held accountable for violations of international human rights. Rachel Corrie, a young American killed abroad because Caterpillar purposefully turns a blind eye as to how their products are used, must have access to justice.”

Or, instead of totally freaking, you could do a little checking first. My guess is the other insurance company can easily bury another $500 in their settlement of the claim to cover the damage to the rental car. They've already got a reserve set because of the property damage and the injury; any decent adjuster will add in a touch extra to keep you happy. Don't make a big deal out of something until you KNOW it's a big deal.

This time is quite a deal really. This is the fifth time that S/O's car got rear-ended. Those other times the party at fault either had no insurance or a hit-and-run.
She will call up her State Farm agent this morning to report.

Which one? The Off-Trak? Metro-unlink? Actually, she did try the latter. It was great until she got off the depot in Simi Valley, a hundred mile from where we live. She had to wait an hour for two city buses for another hour ride just to get to the clinic where she works. It's a mere one mile!

Yes, she's been looking for another job now that the economy has recovered! Umm, this is not the "Friendly" Political Ranting forum ;)

Did she charge the rental on a credit card that offers rental car insurance? Many do. If she charged the rental, which I'll bet she did since most rental agencies require a credit card for rental, have her call the credit card company right away and ask if she is covered.
