AppleCare Hell; Follow-Up, Part D – “Ever the Woeful Optimist”

Well, no happy ending yet. Ali called back late yesterday, while I was out of course, and did leave a voice mail for me; she said she had no luck getting through to CUSA, and would be trying again today.

CUSA is starting to have a history of avoiding with the problems they create. I have now called at least seven stores, two regional offices, and a corporate customer service center, and have been hung up on more times than I can count, though I’ll at least provide today’s tally:

CUSA Burbank – 7 cycles through their system, was hung up on after 3rd and 7th cycle by female and male respectively.
CUSA Woodland Hills – 5 cycles through system, left on hold by female after 2nd, transferred by female after explanation on 5th to male (think was Apple specialist) who hung up on me.
CUSA Glendale – automatically hung up on by system after first cycle, as this store uses different system than other stores.
CUSA Anaheim – spoke w/ “Brandon” four times during 9 cycles through their system, ultimately giving him enough of the story that was relayed to his manager, and then the Apple specialist, and then the manager again, and then he finally provided me with a different local number for regional general management. Thank you Brandon.
CUSA Regional (local #) – 2 cycles through a different system before speaking w/ female, who after brief explanation transferred me to Redondo Beach store.
CUSA Redondo Beach – spoke w/ male after transfer, who then transferred me to “James”, the manager of that store. After five minutes of the short version, James gave me the name and number of the next rung up the ladder; Olga at (800) 849-4622, whom I left a voice mail for. From what James told me, her office oversees the Los Angeles area and Hawaii stores, and that’s what the voice mail greeting on that number says. Thank you James, it sounds like Olga is the person Ali, and I, and the designer’s attorney need to be talking to.

I still haven’t heard back from Chris (the other CUSA store manager I had dialog with, and sent documentation to, in Follow-Up’s, Parts A & B of this saga) since last week. I’ll be faxing Olga’s contact number to Ali shortly, and will then try to get back to some real work for the rest of the day. I’ll post any breaking news as soon as possible.

After following the saga, I simply don't understand why you are spending sooooo much time on the phone with so many CUSA departments. Do you not have the number of the local Attorney General's office. Why are you dealing with those fraudulent goons?

Also, a lot of folks get a perverse thrill watching the monkeys dance.
Also, he/she thinks that they are an incredible writer, and that the whole forum is on the edge of their collective seats waiting with bated breath for the next exciting installment of "Boredom Theatre". Seems like the same person (different nick) did this at DealCrap also. Had these ultra boring, multi-part continuing sagas that went on and on. That was years ago though.

I guess the real reason is, that given my severe neurological impairments which include not being able to lift my right arm, having limited range of motion with my right hand and wrist, not being able to close or hold anything in my left hand, having a pronounced foot drop in my right foot, and having a severely atrophied and unstable left knee, upper leg and thigh... I can't beat or kick the crap out of the people that need the crap beaten or kicked out of them to more quickly and satisfactorily resolve problems like this. Plus, I want to set a good example for my 11 year old son.

Stay tuned for Part E, it's gonna be a doozie..., after posting Part D here, Ali called back (still no luck getting through to CUSA), plus the designer found someone likely better than an attorney for this type of problem whom also called me, a specialist with a company dealing in Information Security, Privacy Auditing & Compliance Services to stick on CUSA. The optimist in me is hoping this will still somehow work out better, or at least close to as good as an old fashion beatin' or crap kickin'.

Buzz, I hadn't realized you were talking about the Burbank CUSA. Something similar to your story happened to me at the same store a few years ago. I purchased an open-box QuickSilver Dual Gig machine there; the salesman swore the machine had never been sold and had only been demo'ed. It wasn't until much later, when I had the power supply repaired under warranty, that I learned that the machine was covered by AppleCare!

I came out ahead in my particular transaction, as the machine I bought was reliable and I received almost three years of AC for free. The fact remains, though, that the Burbank store has been guilty of this behavior on at least two separate (documented) occasions.

After all the advice given in this Forum, I really, truly do NOT UNDERSTAND why Buzz had not contacted his local District Attorney's Consumer Fraud Division, or better yet, the State equivalent. Perhaps there is some difficulty grasping this fact: situations like this are exactly WHY those offices exist, and they will do something about it.

Also, per my advice three times as I recall, Buzz could just as easily trapse down to his local courthouse and file a nice, fat $10K or higher Small Claims action against CompUSA, and specifically the manager there that has apparently decided to stonewall the dilemma.
Getting served with some court papers would do wonders to wake him, and CompUSA up big time.

Being the "Woeful Optimist" is getting old to me. I'd want something better to be happening at this point, and the legal remedies available to Buzz are easily available.

Given your recent replies, my knee jerk reaction was that I'd ask that you to spend a day, or even an hour, with my neurological afflictions; but then just as quickly as I realized I no longer have any reflexes left, and therefore my knees can't jerk, I realized your afflictions are obviously so significantly worse than mine, that you'll never understand. The optimist in me, woeful or not however, continues to hope that perhaps someday, soon, you will.

rexrzer- I have contacted the local DA's office, the Better Business Bureau, and Dept of Consumer Affairs, the latter two being favorite referrals of the first, along w/ your aforementioned Small Claims action. As this case isn't in the DA's wheelhouse on a standalone basis, and the BBB and DCA are basically just scorekeepers, that really only leaves the Small Claims thingy you keep bringing up. There are at least two other things you really, truly don't understand; the first is how difficult "traipsing" anywhere is for those us with physical handicaps. Traipsing to the local courthouse, etc., requires me to drag my wife, or some other caring soul, to help, and all in all, a $10K+ action isn't all that "nice and fat" in the grand scheme of life. Just give me a mid-level G5 w/ 4GB RAM, and set the record straight w/ the designer whose data CUSA compromised, as doing the "right" thing is often better than doing "nice and fat".

The second thing you don't understand is that by making this public record, it is easily published and referenced, and as noted previously in it, has now been furnished multiple times to CUSA and Apple. This cuts the "he said/she said" down to the quick should this ever have to go to court. As RAMd®d noted in a reply to one of my earlier posts, when you get to Small Claims Court, it's up to the judge to rule on intent. CUSA and Apple have not denied a single statement I have claimed, yet they are going out of their way to avoid liability. I suspect they will continue to do so until this matter reaches critical mass. This record clarifies intent, and the clearer the intent, the more critical the mass.

The real, stupidly sick thing about this dilemma is, that had AppleCare and CUSA gotten their little heads together a whole lot quicker while the MDD was sitting at MacMall; the MDD would have been fixed, the hard drive would have been replaced and the old one trashed, I never would have known I had been scammed when CUSA originally sold me the MDD, and CUSA's malfeasance w/ the designer's data (and possibly "P.M.'s") would also never have been discovered. Should, by chance, rexrzer, you really do understand the second thing, then thank you for the opportunity to further embellish the public record.
