Need eBay advice - seller slow to ship, respond, i want to cancel

i purchased something from an ebay store about three weeks ago. At the two week point i contacted the seller to ask if the item had shipped yet - he did mention that it could take up to two weeks to ship. I get a response stating exactly that even though the two weeks were up. I respond to him pointing this out. Three days later i still haven't gotten a response so i send an email telling him i want to cancel. I get a response saying that the item has already shipped. I ask for a tracking number. 24 hours later I still haven't recieved one.

What should I do?

At this point I still want to cancel with him. Communication has been poor and slow.

This is the kind of stuff that has stopped me from doing any business on eBay. Hope it is in the mail and you get it soon.

How much are you out? What kind of feedback did he/she have?

Hate to say it, but I usually treat most eBay transactions like I was in Vegas (or, Vegas with a bit more security): you may or may not see a return on your investment, so to speak.

Sheesh...are they on this continent? That's poor poor business. Although, it can be similiar to places like SurplusComputers winking smiley The only stuff I've had take that long is Media Mail generally through Half.Com unless it was coming from Asia.

i paid with credit card via paypal - its incredibly easy for me to cancel.

You can't cancel the sale, only file a Payal complaint for non-delivery. Seller has a set time to prove delivery or they get charged back the amount you paid and you get credited.

I can also cancel through the credit card but perhaps it is best to avoid that

I would have avoided the sale. Two weeks to ship. And feeding you bull after the sale.

I bought a Software CD from a seller. He filed a USPS tracking number online. USPS website stated that the package has not been received by them. I filed a non delivery complaint. He responded with the same tracking number from USPS. Anywho, I eventually won the complaint and I was credited the amount back to my credit card.

File the item not received complaint with PayPal. The seller has to provide a tracking number, and it has to show delivery. If it doesn't, PayPal will find in your favor. If they can recover your money, great. if they can't, then you go to your CC company for a chargeback.

You should always go to PayPal first. If you go straight to your CC company, PayPal reserves the right to permanently suspend your PayPal account.

You and the other party have 30 days to complete the transaction according to eBay rules. Be patient. I once used most of this 30 day limit when I bought a car ($19,100) on eBay (the seller had an immediate $500 down payment with the balance due upon pickup.) He asked for a quicker completion but the eBay rules permitted 30 days so he simply waited.

PayPal rules give the seller 7 days to ship if he wants to be covered under their policies. if he hasn't shipped yet, he may not actually be planning.

Again, file the INR. PayPal then gives the seller a few days to provide a tracking number and for the item to actually be delivered. if it isn't, you win the dispute.

Oh, and buyers have 45 days from payment to file INR claims with eBay and PayPal. eBay has no such 30 day rule, Speedy.
