East Texas strikes again

A federal jury in Texas said Apple Inc must pay about $308.5 million to Personalized Media Communications LLC (PMC) for infringing a patent associated with digital rights management.

This company doesn’t actually make any products, but it sure does sue big companies. Google, Netflix, Apple. The plaintiffs asked for $240M in damages; apparently that wasn’t enough for the jury, so they awarded ~$70M more.

The “Rocket Docket” in Marshall, TX was theoretically reformed because of past abuses; looks like they have further to go.

It was reformed, after Kraft Foods took the issue to the Supreme Court, where the obvious limitation was placed that a company bringing suit had to be created/incorporated in whatever state they wanted to sue someone.

PMC is a Texas company.

Patent trolls are a bad use of capitalism, but nearly every university who makes new inventions is a non-practicing entity (and would be caught in any legislative reform without being given a special exception).

I know a company that started out setting up their product, then a Big Co started using identical technology and that company decided it was easiest to stop developing it, wait for Big Co to bring it to market, then sue Big Co. They are a startup, it would be impossible for them to compete with Big Co - and their investors have a potential exit.

I do not know the merits of this case against Apple, but if it's like the example above, Apple surely factored in the cost of the law suit in their business decision on the tech.

Apple closed its Applestore in the district, so it can reasonably argue it has no business interests in that courts juristdiction.
