Nirvana Sued by Baby From Nevermind Album Artwork for Child Pornography

In a lawsuit that also named photographer Kirk Weddle and the labels behind the album’s release, Elden claims he has suffered “lifelong damages” and says his legal guardians never signed a release “authorizing the use of any images of Spencer or of his likeness, and certainly not of commercial child pornography depicting him.” He’s also suing for distribution of private sexually explicit materials, negligence, and what’s described as a “sex trafficking venture” where Elden “was forced to engage in commercial sexual acts while under the age of 18 years old.”

So was he offended before the attorney got to him? (the attorney who will get around 40-percent of any settlement)

That's claiming criminal activity.

It would be interesting to know how the plaintiff supports that allegation.

This will be an interesting chain of events, if it goes anywhere.

I think if no one can produce a release, or meaningful testimony of a release, there's a possibility of a settlement/trial for him. Someone wasn't doing their job at the label that released the album art.

Apologies to the anonymous forum member affected by my previous sig pic. It was my personal pic of a country expressing great grief as their leader, one of the most recognized people in the world, lay on his deathbed 8 years ago, days before he died. Like a naif, I did not realize it was offensively political, I considered it an expression of deep emotion and a reminder of the mortal coil's nature; that we all, great and small, can only hope to make a difference in our short time here, no matter the personal cost.

I'll post another pic from my work in South Africa that is, hopefully, apolitical.

I just watched a 1975 episode of Play School, a UK show for preschoolers. In this episode, they showed a mother changing a baby's diaper. Oh no...child pornography! This baby's life has been ruined by this sex act! Time to sue!

While I'm not an attorney, even tho I play one on TV, there may be statute of limitation issues. Could also be that state laws may be seconded by federal law...

It really wasn't until the mid 80's that we as a country started to get weird about nudity on album covers.

IIRC, there was a different cover for the USA version of Roger Waters's The Pros and Cons of Hitch Hiking that had censoring.

Based on the reported facts, at most the liability is for the absence of a release. Defendants will probably argue that there was a verbal agreement, which probably blocks that liability, assuming there are credible witnesses.
Child pron? Seems like a non-starter.

My analysis: this is a guy with a lawyer trying to shake some "it's not worth it to litigate" money from the defendants. We'll see if he gets anywhere.

This idiot’s dad was published some years ago providing consent for the photo shoot. However, he said he didn’t know what it was for. So that could be lacking consent since the purpose wasn’t apparently shared by the photographer.

But all of that porn stuff is some lawyer filling his noggin with B.S.

It’s a bummer this guy was drawn to sue because of his own money troubles and inability to process why he’s a historical footnote. None of which means anyone owes him anything here.
