A judge has dismissed Spencer Elden’s lawsuit which alleged Nirvana violated federal child pornography statutes when it published the iconic “Nirvana Baby” as the cover of its “Nevermind” Album.


In late summer of 2021, Elden sought damages in a lawsuit regarding the album cover photo against record executives, band members, the photographer Kirk Weddle, and the executor of Kurt Cobain’s estate. Elden alleged that the band’s “Nevermind” album cover, which features Elden nude as a four-month-old baby, constitutes child pornography and is child sexual exploitation.

He says he was not able to give permission for his likeness to be used on the cover and that his legal guardians didn’t consent, either. However, Elden’s parents were paid $200 for the photo, after his father took Elden to an aquatic center where Weddle had arranged to photograph children during a pool party.

As reported by SPIN, Nirvana fought to have the case dismissed, and noted that Eldan had “spent three decades profiting from his celebrity as the self-anointed ‘Nirvana Baby.'” The band’s estate also pointed out that the statute of limitations for the lawsuit expired over a decade ago in addition to arguing against the case that the situation constituted child pornography.





No word yet on Weird Al suing himself.

This guy has got to move on and create a life for himself before it's too late. He's been trying to live off of this photo his whole life. Time to move on buddy...

I have heard about this as it unfolds. The guy even has a Nirvana tattoo. If he is so wronged by them, why get that tattoo, and why wait all these years?

Probably because he's seen all the whiners who try (and occasionally succeed) in getting a big pay day. Couple that with liberal Ah0le judges who are happy to toss aside Statute of Limitation laws and it seems anybody who wails "poor me" has a shot at cashing in, facts be damned. boink smiley

He has also recreated the image from the album cover on at least four separate occasions for various publications, albeit always with a bathing suit on.

He is an artist, was having a show of his work, and tried to get in touch with the surviving members of Nirvana to invite them to the show through managers and/or the record label even though, IIRC, he had never actually met any of them in person. Predictably, he got the runaround and took that VERY personally... Hence the lawsuit.

I was hoping it would be revealed that he wasn't the "Nevermind Baby" after all, but a summary dismissal will do.

I saw an episode of Play School (UK), in which kids were shown a baby's diaper being changed. Child sexual exploitation? I think not.

Hard to see how this flies for all kinds of reasons, one being if this is child pornography, are the millions of us who own this album guilty of possession? Yep. He must be pissed that they didn't somehow know this album would sell millions and make Nirvana internationally famous, and ask for royalties.

No real difference. COMMON SENSE seems to be MIA on ALL sides these days. A judge doesn't doesn't have to work very hard to find a reason to be, IMHO, an "Ah0le".
