Followed by 3 years supervised release.

Judge:

"Failure is normal. Failure by fraud is not ok."

"What is the pathology of fraud? The inability to accept responsibility?"
..

Coming next, financial penalty. $120m mentioned in the hearing today.

Her surrender date is late April; she will have her baby outside prison.

Yep, she will have the baby before she surrenders herself in late April.

She's 38, and knew she was headed to prison for a long time. Last chance to have children. They'll be raised by her husband and Mom.

Devastating for that older child, who obviously has bonded with her.

She'll be in Minimum Security which has very liberal visitation. It won't be easy but the children will be able to see her regularly. Somewhat akin to supervised visitation after a divorce. Not being able to give the baby the nutrients and immunity from breastfeeding is sad for the child.

Federal inmates get 4 hours of visitation per month, normally. She will likely be in a prison far from where her family lives, unless they move. Even with more visitation time, it is horrible.

The visits are in one big public room, there is no privacy, and the time of course is restricted.

Sorry, but this is nothing like supervised visitation after divorce, where the setting can be made very child friendly and visits can be frequent.

There is a lot of mythology about "minimum security prison," it is still prison and it is hell for families with young children.

Especially for the children’s sake, I wish this had never happened. Scamming rich, powerful people is the sure way to prison. They probably know how to do it to others and not get caught.

Apparently she didn't learn how to do it and not get caught. She came from money. Her father was a VP at Enron at one point, and she grew up with other well off families around.

She's got plenty of time to make new friends, especially with her grift of gab.

I'm ok with the sentencing, but would have been more OK with 15yrs and supervised release for 3-5yrs.

But it's more than I thought she'd, somewhere in the single digits.

I think it's appropriate, and I'd like to see insurrectionists related criminals get equally appropriate (read: longer) sentences.

is there anything in the sentencing guidelines that says she cannot profit from selling the book or movie rights?
or her husband?
or children?

US TV is a sap for 5h1th3@d$.

Is there anything that proves she DID NOT manage to skim a couple off the top before the whip came down?

who'd she defraud for $700M? Other hedge fund type scum?
or ma & pa kettle?

forgive me for being a cynic about this.

I have a friend who is in a low security federal prison. It's not a country club at all, although they do have a walking track. Plus, and he says this is typical, for the first year they put you in a gen pop normal federal prison and move you from one bad place to another. His family would not know from day to day, phone call to phone call, where he would be in the early days.

I can't imagine what that will be like for her children.

The fraud didn't come at the beginning. She was naive about scientific advancement, about science, and about medicine, and seems to have developed and sold a fantasy about developing a new technology that would fit the market perfectly. The fraud came when the company failed to create the new technology -- at that point she had a duty to the next round of investors that there was doubt and risk -- and the company pretended that their unworkable systems were churning out blood test results. They faked the whole thing by buying technology that was already available to every clinical lab and running tests on that equipment on the sly. Equally bad, they ran a few tests on their own equipment and provided results, even though their own people were telling them that the systems were untrustworthy. The book about the whole thing made it clear that the top people (including her boy friend) were doing their best to intimidate the workers against letting people know what was going on.

There are lots of proposed drugs that cost lots of money to develop and then fail in phase 3 clinical trials, the results are made public, and the usual result is a drop in the stock price of the company. Happens all the time. You used to be able to read about such failures on MedPage. I assume there are still lots of such stories. It seems to be a case where the FDA and the SEC are doing an OK job. By the way, the trustworthiness of the system is why many of us were fine with the approval of the Covid vaccine.

The FTX founder is currently in the Bahamas.

Latest reports noted he diverted at least $300 million to himself personally.

Given that amount of scratch there are plenty of non-extradition jurisdictions that will welcome him with open arms.

If he don't wanna be caught, he won't be.

So she will come out of prison to a budding teenager.

She may want to consider staying in longer, it would be less of a punishment.

Yes, she’s a natural actress. She invented a persona that enabled her to convince a lot of older white men to give her $$.

And likely was able to use that same charisma to get off on some charges. I was afraid it would greatly reduce her sentencing too.
