Command + Shift + N to create a new layer? Or select the move tool and hit delete to delete a layer (He kind of munges 2, 3, and 4 together. I'm not sure there really was a "2".)? Both work in CS3.

the delete the layer thing. It's a no go in PS7 ( CS1 )

Actually PS8 is CS1. Same results though; it doesn't work in PS7 or 8. It does work in CS2 though.
