AT&T want's you to pay

Downloaded AT&T's myWireless iPhone app with the intention of just using to monitor my plan usage.
Before launch, the app has a long user license agreement which I decided to review before hitting "Accept."

What do I find in there but item 3.4 which basically says, if any third party makes a claim that this app infringes on their intellectual property rights, you, not A&T, will "be responsible for the investigation, defense, settlement and discharge of any such claim."

Would this outrageous license section actually hold up in court?
"Hey folks we wrote the app, but if we stole anything in writing it, you're the ones who'll be paying for the theft, not us." soapbox smiley

Tough one. I've seen similar clauses in other types of contracts but generally they're part of much more complex situations than this.

probably not, but I'd guess not putting it in there would reap consequences they'd otherwise somehow be culpable.

Still not as good as the total WIN from the UK firm "Gamestation" whose online TOS included the term that use of their site granted Gamestation rights to the users "Immortal Soul".

I would send the TOS terms to Steve Jobs in an email. Take it to straight to the big man on campus.
