He's no longer an elected official nor an official spokesperson for his party, why would they list that he's a Republican?

I think you mean you hate it when FOX doesn't list the party of the scandalized criminal Republican, as is their habit. (Though they sometimes label the person as a Democrat, hoping no one will notice.)
It's a wire story, but it was edited and published by Fox. Other AP versions of this story out today include Mr. Delay's party and the fact that he's the FORMER speaker of the house, and lots of other info. Here's one version.

Calm down. When this OP first went up, the linked article was very short and did not include any reference to Delay's party. I read it myself and was also surprised, especially since other versions of the AP story were much longer. Fox has since gone back and edited the story again, making it much longer than the original version and adding the party affiliation in.
This is actually not that unusual for an online journalism practice, to put out a very short version, collect more information, then put out a lengthier version a little later.
