Too bad he didn't stay alive just long enough to see a conviction finalized.

Is there room for a civil suit against the widow and estate in this case? If so, they should definitely proceed.

hehehe, and you, mine.

Yes civil suits can be filed, but by the time they come around most of the loot will be hidden/dispersed accordingly in trusts and such.

I was SO worried that his wife & family might have to scratch by living an upper-class life instead of a millionaires life as they are accustomed.

U.S. District Judge Sim Lake, in a ruling Tuesday, agreed with Lay's lawyers that his death required that his conviction be erased and his indictment dismissed. They cited a 2004 ruling from the 5th U.S. Circuit Court of Appeals that found that a defendant's death pending appeal extinguished his entire case because he hadn't had a full opportunity to challenge the conviction and the government shouldn't be able to punish a dead defendant or his estate.

I wonder if that would hold if there's a clear determination of suicide?

He is still libel for civil courts. The money still has to be paid. Only the printed conviction is dismissed as I understand it. He didn't get out of anything.

Well actually he did get out of everything.

Problem is in most cases bringing a civil suit following a criminal conviction makes the suit a slam dunk. Sans criminal conviction the civil suit may still prevail but the odds decline and the legal costs go up, substantially.
