Mitch says they aren't coming back till the 19th

So, once again, MM pretty much shuts down the impeachment process.

The new congress is seated January 3rd, so he will no longer be the majority leader.

Edit: But the tie-breaker will be Pence until the 20th, so I guess it don't make no nevermind.

They can have the trial after the 20th, I believe. The important thing is to make sure he can never hold federal office again. We have to worry about a foreign power funding another run by him.

Exactly. And there's still always the 25th, though it's looking less and less likely that's going to happen.

They can't return, by Senate rules, without unanimous consent. Even if a justice died, Mitch couldn't call the Senate back before the 19th.

Although the Senate will hold two pro forma sessions next week, on Jan. 12 and Jan. 15, it is barred from conducting any kind of business during those days — including “beginning to act on received articles of impeachment from the House” — without agreement from all 100 senators. With a cadre of Trump-allied senators in the Republican conference, that unanimous consent is highly unlikely.

“Again, it would require the consent of all 100 Senators to conduct any business of any kind during the scheduled pro forma sessions prior to January 19, and therefore the consent of all 100 Senators to begin acting on any articles of impeachment during those sessions,” the memo from McConnell emphasized.
