Judge's ruling opens door for much longer sentence for Derek Chauvin

"A Minnesota judge has found aggravating factors in Derek Chauvin's murder of George Floyd — a finding that dramatically increases the likelihood of a longer sentence.

Chauvin, a former Minneapolis police officer, was found guilty last month of second-degree unintentional murder, third-degree murder and second-degree manslaughter in the death of George Floyd in May 2020.

Judge Peter Cahill said in an order made public Wednesday that four aggravating factors are present in the case: Chauvin abused a position of trust and authority as a police officer, treated Floyd with "particular cruelty," committed the crime as part of a group with at least three other people, and that children were present during the commission of the offense"

The 'children present' issue has been obvious from the beginning, meaning the likelihood of longer sentencing implicit.

Nothing about this case was "obvious from the beginning." He was not even charged at first. Then not charged with murder. Then charged with murder. The whole world held its breath to even see a guilty verdict.

The usual sentence was 12 years, but the prosecutor is making a special request for more time. That ruling only came out yesterday. It could have gone the other way.

Is more jail time now a panacea for the left? The idea of jailing people as deterrent cuts both ways.

I roll my eyes when someone says "the left." You're talking here to about 10 people. Nobody speaks for the entire tribe.

What seems like an appropriate sentence to you?

12 years did not seem appropriate to these prosecutors and I agree.

That's more of a statement, not a question and makes some assumptions.

There's no doubt in my mind that at no time did Chauvin think 'I'm gonna kill him'.

But what he did was far beyond the pale of 'I didn't mean to kill him'.

I think 12 years was too little, or maybe more accurately, that the 'normal' sentence wasn't enough.

He wasn't what most would call a good cop before this.

How much is enough, how much is too little, how much is too much?

I don't have an answer for that.

A man is dead, and a police officer who shouldn't have made the mistakes he did and had more than one opportunity to preserve the life of the other but failed to do so, is going to prison.

For me, there's no panacea for any of that.
