This is a wrinkle I'm not familiar with, particularly the should be thrown out part.
So did he throw out/dismiss the case?
And if so, why let the jury continue to deliberate?
Is this just to see what they would have decided if the suit were valid, as if the plaintiffs team actually did their job?

If the jury is not sequestered and has access to their cell phones it seems very likely that they will become aware of what the judge has said while they're still deliberating. Wouldn't that taint the jury and be the basis of an appeal if they find against Palin?
