....news is breaking.....

Trump says FBI raiding his Mar-a-Lago home

....The FBI is raiding Mar-a-Lago, former President Donald Trump's resort home in Palm Beach, Florida, Trump said Monday evening.

In a lengthy statement, Trump said his residence is "currently under siege, raided, and occupied by a large group of FBI agents."

The raid was "unannounced," Trump said, adding, "They even broke into my safe!"

The FBI did not immediately respond to CNBC's request for comment on Trump's statement.

The former president, who summers at his golf club in Bedminster, New Jersey, was not at Mar-a-Lago at the time of the raid, NBC News reported.

There are multiple active investigations at the state and federal level related to Trump, his business and his family. The DOJ reportedly is investigating events leading to the Jan. 6, 2021, riot, when a mob of Trump's supporters stormed the Capitol and delayed confirmation of President Joe Biden's Electoral College win by Congress.

A federal grand jury has also reportedly been empaneled in a probe into 15 boxes of White House records, some of which was marked as classified, that were sent to Mar-a-Lago instead of the National Archives.

"If your home is searched by the FBI, you're in big trouble," former federal prosecutor Renato Mariotti said Monday evening on CNBC's "The News with Shepard Smith."

The raid came hours after Politico reported that attorney John Rowley, a former federal prosecutor, is now representing Trump in talks with the Department of Justice about executive privilege issues related to the department's investigation of the Jan. 6 Capitol riot.

what.....are they looking for......?!

All the good stuff, anyway …

Love how FBI allegedly "broke open a safe" to examine classified documents that el Dumbfo squirreled out of the WH.

He will spin this to wind up his minions … already:

“These are dark times for our Nation, as my beautiful home, Mar-a-Lago in Palm Beach, Florida, is currently under siege, raided, and occupied by a large group of FBI agents,” Mr. Trump said in the statement. “Nothing like this has ever happened to a President of the United States before,” Mr. Trump said.

Keep the pressure on, but expect all of it to simply be denied, deflected, and used to rile up his brainless followers.

This is a major move. There is no way a judge signs off on this raid without a serious chance of finding something. If they had to break into his safe, that means he refused to open it when directed to.

Very good question. Who's watching the raiders to make sure they aren't destroying an evidence they find??

pie for everyone!!

"Nothing like this has ever happened to a President of the United States before. After working and cooperating with the relevant Government agencies, this unannounced raid on my home was not necessary or appropriate," Trump said. "It is prosecutorial misconduct, the weaponization of the Justice System, and an attack by Radical Left Democrats who desperately don't want me to run for President in 2024, especially based on recent polls, and who will likewise do anything to stop Republicans and Conservatives in the upcoming Midterm Elections."

"Such an assault could only take place in broken, Third-World Countries. Sadly, America has now become one of those Countries, corrupt at a level not seen before,"
Trump said, alleging that the FBI agents broke into his safe.

The raid was "unannounced," Trump said, adding, "They even broke into my safe!"

Well, the lack of announcement is a key component of a raid.

Frank Figlusi(sp) says not raid, execution of a judge approved legal search warrant.

Toh-may-toh, toh-mah-toh, still a distinction without a difference, practically speaking.

But the mention that it's a warrant service is a good.

Apropos of nothing, the jackets with the agency names across the back, FBI/DHS/POLICE etc., are known as raid jackets, even though they aren't restricted to use in raids.

I imagine the Secret Service agents guarding his compound, even though he was not there, were not happy.

Is there some factual basis for that, or is it just typical Speedy musing?

No idea where you are hearing that but it isn't true.

There is nothing that could stop Trump from being elected, even if he is sitting in federal prison. Potentially the 14th amendment might, but that would end up before SCOTUS and it is highly doubtful they would disqualify him.

The only other disqualification would have been while he was still in office, that did not occur.

So, potentially, in theory, Trump is convicted and sentenced to prison, he still runs and is elected, he then pardons himself and walks free.

"This all raises the question: Can Trump be prosecuted for violating federal law? And if he is found guilty, could he be blocked from seeking the presidency again?

According to the Congressional Research Service, anyone who engages in the “unlawful removal or destruction of government records” is subject to punishment under Title 18, Section 2071, of the US Code. And that section notes:

Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States. [Emphasis added.]

In case you missed the italicized words, the punishment includes a ban on holding a US government position. So, would a guilty verdict prevent Trump from trying to move back into 1600 Pennsylvania Avenue? ...

A NYT article dealing with exactly this question - [www.yahoo.com]

In short, it would not bar him as the Constitution deals with presidential eligibility as well as disqualifications, it would supersede the federal law.

Once a person meets the basic qualifications (age, birth site, time in-country) the only disqualification is impeachment followed by a senate vote to disqualify.

Charles Manson, Aldrich Ames, and Bernie Madoff could have all been elected after being found guilty of their crimes. Oddly, they could be elected while in jail but could not vote in that election (other than in Maine or Vermont)

"In short, it would not bar him as the Constitution deals with presidential eligibility as well as disqualifications, it would supersede the federal law."

This has never been settled by a Court. We are in uncharted legal and political waters.

It's been said by a number of presidential historians that the framers never anticipated a person as lawless as Donald Trump holding the highest office in the land. They created a political tool for removing the person, perhaps not understanding the limitations of that tool.

Richard Nixon showed us we needed a legal tool as well, so the Presidential Records Act was passed in 1978. It's there in black and white, a person convicted of this is ineligible for federal office and cannot handle classified documents. This law has never been found unconstitutional.

That is because our country's most important democratic value is that no person is above the law.

I find it difficult to believe that a court even as partisan and cynical as the one we have now would violate that principle.

This question asked just now on a local radio show and a retired federal judge said that she doesn't believe that this would bar him from the presidency again, but that it would be caught up in legal proceedings for a long while.

From the NYT:

If Trump broke a law on the removal of official records, would he be barred from future office?

Quote

… On its face, then, if Mr. Trump were to be charged and convicted of removing, concealing or destroying government records under that law, he would seem to be ineligible to become president again.

… But in considering that situation, several legal scholars — including Seth B. Tillman of Maynooth University in Ireland and Eugene Volokh of the University of California, Los Angeles — noted that the Constitution sets eligibility criteria for who can be president, and argued that Supreme Court rulings suggest Congress cannot alter them. The Constitution allows Congress to disqualify people from holding office in impeachment proceedings, but grants no such power for ordinary criminal law.

Bottom line from this piece is, it’s uncharted territory, and would be a legal fight, with a good chance of invalidation.

Related: Maggie Haberman of the WaPo released some photos yesterday in promotion of her new book:

Quote

Haberman — who obtained the photos recently — shared them with us ahead of the Oct. 4 publication of her book, "Confidence Man: The Making of Donald Trump and the Breaking of America."

A Trump White House source tells her the photo on the left shows a commode in the White House.
The photo on the right is from an overseas trip, according to the source.

Heather Cox Richardson is a little skeptical - too perfect, she says - the provenance is unclear, we don’t know who wrote the torn-up notes if they are real, or what they’re about, and they don’t really confirm anything that we didn’t already know. So these should be taken with a large grain of salt.

Do you honestly think that the people who sought the warrant and planned the raid had no idea what the ramifications were? That they would say, oh it doesn't matter if we find anything or not, raiding a former President's home is no big deal? My feeling is that this has happened because they were completely certain that it is worth the furor they surely knew it would cause.

There's been so much time to destroy any incriminating documents among those boxes, bury any smoking guns, that I have some doubt there will be the slam-dunk results one hopes for in the execution of a warrant.

As this is an unprecedented move, I'd assume the affidavit was scrutinized six ways from Sunday by the affiant, his or her superiors, Garland or his designee, and certainly the judge signing off.

I hope this turns up something huge.

The number of Repubs who're condemning the raid isn't surprising, but is supremely disappointing.

I am that Masked Man.

Your boos mean nothing to me, I've seen what you cheer for.

Insisting on your rights without acknowledging your responsibilities isn’t freedom, it’s adolescence.

I've been to the edge of the map, and there be monsters.

We are a government of laws, not men.

Everybody counts or nobody counts.

When a good man is hurt,
all who would be called good
must suffer with him.

You and I have memories longer than the road that stretches out ahead.

There is no safety for honest men except
by believing all possible evil of evil men.

Makes me wonder if they have a mole in Mar-a-Lago, and if they know on recent advice that there is still something in the safe that shouldn't be there.
