On Aug. 29, 2021, when she was starting her sophomore year, Villarreal said she was raped by a member of the school’s baseball team, according to the lawsuit.

“Plaintiff Villarreal was paralyzed with fear and the assailant proceeded to penetrate her with his penis,” the lawsuit states. “The rape concluded only after Plaintiff Villarreal told her assailant to stop.”

We get Hillsdale’s newsletter in snail mail. My wife likes to read it for its commenterians’s use of fact-free twisted logic. I like to get it because I figure it costs them close to a buck to mail it. I’ll also let their commercials on YouTube play through to the end and then click the More Info link so they can pay a tiny bit to Google.

But with that huge endowment only a scandal as big as Falwell and Liberty will make a dent.

Given the scenario that they were on a romantic date, I think the keyword is ‘stop’ and when it was said and what happened immediately thereafter. I have seen a scene in a TV show where the male is making out with the willing female and then stops to ask if he can kiss her neck, later he stops to ask if he can put his arm around her, then he stops to ask if he can … seems like a real buzz kill for both to ask permission but that was what the college code the couple was following required (the female eventually objected to the frequent asking of permission, but not the activity - but then it was a fictional TV show probably written by males - and she ended any further interaction because of the frequent questions). I think the female can indicate through other means than a verbal exchange that she is ok with more involvement. Certainly saying ‘stop’ is more explicit.

In the first case we are addressing she indicated that the rape ended when she said, “Stop.” What if she had said ‘stop’ as he unsnapped/unzipped her pants? What if she said ‘stop’ as he slid her pants down? What if she said ‘stop’ as he removed her underwear? Was she so paralyzed with fear as these things began to happen so couldn’t utter the word ‘stop’ but was able to exclaim the word only as he penetrated her? Even penetration requires some assistance or acquiescence - or use of force against resistance in the case of a forcible rape. There was no allegation of a threat or use of force mentioned, only paralysis. She was an adult; hopefully she was not so naive or so hopelessly ignorant about sex, so as their interaction progressed that she didn’t know what was happening until paralysis occurred and then passed enough so she could utter ‘stop’. But given this college and its code and the nature of students who are interested in attending this institution, anything is possible. (The college where my wife worked has a mandatory session for new students addressing this type of interaction and I suspect they address both verbal and nonverbal cues.) A conviction for rape requires the preponderance of evidence and the DA decided against charging.

Anecdotally, I have helped remove these garments from willing females and would not have been able to do so, even forcefully, without their cooperation and assistance. Nor did I seek verbal permission, their assistance alone was tacit approval. I have also had my hand removed from a place where my partner did not want it and I certainly understood that that boundary had just been set, no verbal communication was needed - although a ‘stop’ or a ‘no’ would also certainly have achieved the same result but it would have come across to me with an (unnecessarily) stronger emphasis. Had I been less respectful of that boundary then I expect a verbal response (and more) would have followed. Any persistence on my part in such a case equals assault and possibly worse.

Obviously there is probably more to this story than has been disclosed.
