SCOTUS cuts Abbot off at the knees

The Supreme Court ruled 5-4 that federal agents may cut and remove the Razor wire laid down by Texas along the border. Justices Robert and Barrett joined with Satomayer, Kagen, and Brown-Jackson in supporting the administration's appeal.

No explanation was given with the ruling.

Probably because they intend to gut Federal agencies' authority... so they don't view this as a harm to States Rights.

"A strict reading of the law passed by congress doesn't indicate that CBP has authority to remove razor wire, so the Texas razor wire can remain in place."

Maybe they'll even make CBP put it back when they hand down the decision overturning "Chevron deference"... when is that supposed to happen, June?

States rights have never extended to border-protection under the doctrine of federalism. It's called "exclusive jurisdiction." The feds control the borders and interstate commerce. The states control commerce within their borders and control their populations via property, contract, and criminal laws (in order of importance).

Roberts knows they'd be laughed right out of the jacuzzi tubs at the Opus Dei clubhouse if they supported Texas in this.

Easy, the other four were legislating from the bench. Also, razor wire was used against the British to keep them from illegally immigrating in 1791 and during the War of 1812 by the states.



Saint Cloud, Minnesota, where the weather is wonderful even when it isn't.

I think Amy Coney Barrett has turned out to be a bit of a wild card. Aside from being a religious fanatic and staunch anti-abortionist, I'm not seeing any indication that she is into that whole Project 2025 stuff.

Well, she's served her purpose, and if she doesn't toe the line after January 20th, 2025, she'll be replaced by someone who no doubt does. If what Vision63 said in another thread turns out somehow to be wrong.

^ this. There are at least 4 justices who are enthusiastic advocates of political Calvinball; they care not a whit for long legal precedence, or what the Constitution says if it gets in the way of their goals.

Prepare for Chevron, where the court seems poised to overturn the gift they gave to Reagan, solely because the conservative wing doesn’t like living with that ruling under Democratic presidents (and the American public has now majority-voted Dem for president in 7 of the last 8 elections).

If we can't add justices to the court, can we at least prevent two of those four ballers from rendering a decision in this case (and, ideally, any others going forward...?

The majority vote doesn't matter unless you want to make a certain voter feel good or bad and/or talk about nothing. In terms of the presidency, the only votes that matter are the electoral votes and they tell a very different story.
