Supreme Court nominee Samuel Alito defended the right of government officials to order domestic wiretaps when he worked for the Reagan Justice Department, documents released Friday show.

He advocated a step-by-step approach to strengthening the hand of officials in a 1984 memo to the solicitor general. The strategy is similar to the one that Alito espoused for rolling back abortion rights at the margins

The incremental legal strategy is consistent with the approach Alito advocated on chipping away abortion rights. In memos released Friday and last month, Alito said abortion rights should be overturned but recommended a roadmap of dismantling them piece by piece instead of a "frontal assault on Roe v. Wade."

He said of his plan: "It has most of the advantage of a brief devoted to the overruling of Roe v. Wade; it makes our position clear, does not even tacitly concede Roe's legitimacy, and signals that we regard the question as live and open."


So, he lied in 1990 when he told the Senate that he would recuse himself from any case from any case involving Vanguard Securities that might come before him on the circuit bench.

Now we've got two documents in which he advocates overturning Roe and one in which, it could be argued, he advocates overturning the 4th Amendment.

How will he be able to say "I refuse to comment on a case that may come before me as an Associate Justice" when he has already commented on Roe and when Bush's end-run around FISA is almost certainly going to the Supreme Court?

If may be time for the wingnuts...sorry... "the conservative base" to reconsider their objection to Harriet Myers. She may have been completely unqualified, but at least she was not categorically disqualified.

ROE will not be overturned but Abortion through the end of
the term will be. Partial-Birt Abortion - the most Blantent
MURDER of babies will be ended. It's time we put a stop to
the insanity of an abortion any time any where for any reason.
If not - the old folks are sure to be next - Sorry Dr.

Well, actually you are entitled to do this if: 1. you win the election and, 2.it's not unconstitutional. This last, of course, is what the fight is going to be all about. It looks very much like Alito will be confirmed, despite the wailing and gnashing of teeth of the left. The future will be interesting.
